These terms govern your use of this website. They are not the agreement under which Anchor software is supplied — that is a separate contract you would sign as a customer.

1These terms, and what they cover

These terms are between you and Anchor Line Systems LLC, a Missouri limited liability company (“Anchor”, “we”, “us”). They apply to your use of anchorlyft.com and its content. By using the site you accept them. If you do not accept them, please do not use the site.

Important

These terms cover the website only. If you become an Anchor customer, the software is supplied under a separate written subscription agreement. Where that agreement and these terms disagree about the software, that agreement wins. Nothing on this website is a contract for the supply of software, and nothing on it forms part of one.

You must be at least 18 and able to enter a contract to use this site.

2What this website is

This is a marketing and information website describing Anchor’s gym management software. It is an invitation to enquire, not an offer capable of acceptance. Submitting an enquiry or requesting a demonstration does not create a contract and does not oblige us to supply anything.

3Product descriptions and availability

We describe the software as we intend it to work. Software changes: features are added, changed and withdrawn, and some features described here may be under development, in limited release, or scheduled rather than generally available at the moment you read about them.

Nothing on this site is a commitment that a particular feature exists, will be built, or will keep working in a particular way. If a specific capability matters to your decision, ask us before you buy and we will tell you plainly where it stands. Where we have committed to a feature in a signed agreement, that commitment governs.

Our Trust & Security page separates what is live from what is planned. Items shown there as planned are planned, with no date promised.

4Screenshots, figures and examples

Read this one

Every number, name, chart, message and dashboard shown in a product illustration on this site is an example we made up to show what the interface looks like. The revenue figures, member counts, recovery rates, lead numbers, retention curves, conversation transcripts and member names are illustrative. They are not real gyms, not real people, not our results and not results you should expect.

No figure on this site is a forecast, a projection, a guarantee of performance, or a representation about what Anchor has achieved for anyone. Your results will depend on your gym, your market and how you run it.

5Pricing shown on this site

Subscription prices and processing rates are published on our pricing page in US dollars. We publish them because we think you should be able to check the arithmetic before you talk to anyone.

Prices shown are current at the date at the top of this page and may change for new customers. The cost calculator on that page is an estimating tool: it applies the published rates to numbers you enter, and its output is an estimate for guidance only, not a quotation. Your actual costs depend on your real transaction mix, and taxes are extra where they apply.

Where we say a price or rate is locked for existing customers, that commitment takes effect through your signed subscription agreement, not through this page.

6Comparisons with other products

Some pages compare Anchor’s approach with patterns common in this category of software. Those comparisons describe the category generally and are offered as our opinion. They are not statements about any named competitor’s current terms.

Other vendors’ pricing, contract terms and capabilities differ between products and plans and change over time. Always check any other provider’s own current terms rather than relying on anything said here. Third-party names mentioned anywhere on this site are the trade marks of their owners, used only to identify those products; we are not affiliated with, endorsed by, or sponsored by any of them.

7Our content and trade marks

The text, design, layout, code, graphics and arrangement of this site are owned by us or licensed to us and are protected by copyright and other laws. “Anchor”, “Anchor Lyft” and our logo are our trade marks.

You may view the site, and print or download extracts, for your own internal evaluation of whether to buy Anchor. You may not otherwise copy, republish, sell, frame, scrape or systematically extract the site or its content, use it to train a machine-learning model, or remove any notice from it, without our written permission.

Photographs on this site are licensed stock imagery or our own. They are licensed to us for use on this site and may not be extracted or reused.

8How you may use this site

You agree not to:

  • use the site unlawfully, or to break any law that applies to you;
  • attempt to gain unauthorised access to the site, its server, or any connected system;
  • probe, scan or test the site’s security except as described on our Trust & Security page, and then only in the way described there;
  • introduce any virus, worm, or other malicious code;
  • place a disproportionate load on the site, including by automated scraping or a denial-of-service attack;
  • misrepresent your identity or your affiliation with anyone.

We may withdraw access to anyone who breaks these rules, and report conduct we believe is unlawful.

9Links to other sites

Where this site links somewhere else, we do not control that destination and are not responsible for its content, its accuracy, or how it handles your data. A link is not an endorsement. Read the other site’s own terms and privacy policy.

10Disclaimer of warranties

This website is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the site will be uninterrupted, timely, error-free or secure, or that its content is complete, current or accurate. We take reasonable care with what we publish, but nothing here is professional, legal, financial, tax or accounting advice, and you should not act on it as if it were. Take your own advice before making a decision that matters to your business.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

11Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or connected with your use of this website, however caused and on any theory of liability, even if we have been advised that such loss might occur.

Our total aggregate liability arising out of or connected with your use of this website will not exceed one hundred US dollars (US$100). This cap applies to the website only. Liability in respect of the Anchor software is governed by your subscription agreement.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12Indemnity

You agree to indemnify and hold harmless Anchor Line Systems LLC, its members, officers and employees against any claim, loss, liability and reasonable legal cost arising out of your breach of these terms or your unlawful use of this site.

13Privacy

How we handle personal information is set out in our Privacy Policy, and what this site stores in your browser is set out in our Cookie Policy. Both form part of these terms.

14Changes to the site and to these terms

We may change, suspend or withdraw any part of this site at any time. We may also change these terms; the version published here is the one that applies, and the “last updated” date at the top tells you when it last changed. Continuing to use the site after a change means you accept the revised terms.

15Governing law and disputes

These terms, and any dispute arising out of or connected with them or with this website, are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules.

You and we agree that any such dispute will be brought exclusively in [ TO BE COMPLETED: county for venue — e.g. "the state and federal courts located in St. Louis County, Missouri" ], and each of us consents to the personal jurisdiction of those courts.

If you are a consumer, nothing here deprives you of the protection of mandatory provisions of the law of the place where you live.

16General

These terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between us about this website. If any provision is held unenforceable, the rest continues in force and that provision is limited to the minimum extent necessary. A delay in enforcing a right does not waive it. You may not assign these terms; we may assign them as part of a sale or reorganisation of the business.

We are not liable for any failure or delay caused by something outside our reasonable control.
